We are the Festival Fringe Society Limited, a company incorporated under the Companies Acts (company number 46005). Our principal place of business is at 180 High Street, Edinburgh, EH1 1QS. Telephone +44 (0) 131 226 0026. Please remember that throughout these terms when we mention "we", "us", "our" etc., we mean edfringe.com. When we refer to "you" we mean the user and/or browser of our website.

About these terms and conditions
You are reading the terms and conditions for use of the edfringe.com website. They make a legally binding contract between us and you. Your acceptance of the terms and conditions is made by your browsing our website and is dated to your first use of the website. If you do not accept the terms and conditions or any part of them you should stop using our website immediately.

We reserve the right to make changes to these terms and conditions from time to time which will take effect from the date of posting on the website. Your continued use of the site will mark your acceptance of any changes to the terms and conditions.

We may from time to time display additional terms and conditions on our website, for example in connection with a specific promotion or in connection with the sale of goods or services. If the terms and conditions for use of the website should conflict in any way with such additional terms then the additional terms will prevail.

About linking by hypertext to our website
Before providing a link to our site you must seek our permission. To do this, email louise@edfringe.com with details of the URL to which you wish to link and the URL of the page on which you will be displaying the link. We do not permit the display of our web pages in any html frame unless we have expressly authorised this.

The images, graphics, text, applets and scripts operating our website (which, collectively, we call "Website Information") are copyright (c) Festival Fringe Society Limited 2002 unless otherwise stated. You may view Website Information in a web browser for private browsing purposes only. Copying Website Information into a computer cache or storage device for private on or off-line browsing purposes is also permitted. You may not make a copy of the Website Information or any part of it for any other purpose without our prior written consent, which may be granted at our discretion (or where we do not own the copyright, we will direct you to the owner themselves for such consent). Nothing in these terms and conditions or on our website constitutes a licence to use or copy the Website Information.

Occasionally we may publish images or text in which the copyright is not owned by us. Where this is done, and where practicable, we acknowledge the copyright owner.

It is a feature of our website that much of the Website Information is contributed to us by many different third parties and we do not control those parties or their information.

Our web site provides "message board" facilities whereby users may post reviews, information and other text about shows or other matters. We reserve the right to review the "message boards" from time to time and delete any messages or text which we, in our sole discretion decide are inappropriate.

In the unlikely event that you find any inaccurate information on our website or have any complaint about what we have published please email admin@edfringe.com. We will investigate on receipt and take such action which we, in our sole discretion, determine as being appropriate having regard to all the circumstances.

About the Internet, service interruption, viruses etc
We and all other web publishers have no control over the Internet, which is a global public network of computers and the method by which you access our website. As a consequence and in common with most web publishers we take no responsibility for service interruption or the transmission of viruses or other malicious computer code through our website.

About Personal Data and our privacy statement
Where appropriate, we collect and hold your name, address, email address and similar information, which collectively we call "Personal Data". We may collect Personal Data from you when you are purchasing items through our website.

We are registered under the Data Protection Act 1984/1998. We undertake to maintain your privacy within the framework of the law. We shall not pass Personal Data to any third party unless we have received your permission to do so.

If we have received your permission to do so, we will from time to time use Personal Data to inform you of our latest services, offers etc. and the offers or services of third parties.

Our website makes use of "cookies". Cookies are data held in your web browser. They do not in themselves identify who you are or your other Personal Data to us. They do allow us to monitor your use of our site.

Our guiding principle is that your Personal Data is only held to allow us to support and improve your customer relationship with edfringe.com. If you have any concerns about our use of your Personal Data please email admin@edfringe.com. We will investigate complaints, act on emails claiming unjustified exploitation of data and take such further action as we, in our sole discretion, deem appropriate.

Bookings and transactions
We take every care to ensure information provided to us by you is as safe and secure as is practical based on the nature of the transaction. However, every transaction is conducted at your own risk, and we will not be liable for any loss suffered by you except as caused by direct negligence on our part. Orders and bookings made through the Fringe website are non-refundable and non-exchangable from the moment that the transaction is completed. For orders placed through the Fringe Shop, completion is deemed to be when the orders leave our premises. For tickets or goods ordered through the Box Office, completion is deemed to be once you have agreed to the terms and conditions and clicked the "confirm purchase" button.

As an exception, the price of goods will be refunded if we are unable to fullfill the order - for example if a shop item has been discontinued, or if a scheduled performance for which tickets are booked is cancelled, or changes particulars in a manner that results in you being unable or unwilling to attend. Please note that unless a scheduled performance changes from the information provided on our website at the time of your order, we will be unable to offer a refund or exchange - even if you are unable to attend. In all circumstances, any booking or postage fee is non-refundable.

Under the Consumer Protection (Distance Selling) Regulations 2000, you are entitled to a 'cooling off' period of 7 days for items purchased through the Fringe shop. This cooling off period does not apply to tickets and leisure services as purchased through the Box Office, as defined in the exceptions to the distance selling regulations. For the elimination of doubt, there is no cooling off period for tickets purchased from the Fringe, and your booking is non-refundable and non-exchangeable from the moment you click the "confirm purchase" button (unless the performance changes dates / times or other details not in your favour).

For orders placed for postal delivery and not recieved, we will arrange an alternative means of fulfilling the order. You should contact us in good time to inform us of orders not recieved, by telephoning our Box Office for ticket orders, or our Administration office for shop orders. Please note that unless we have been negligent in our commitment to dispatch the goods to you, an order not arriving is not sufficient grounds for a refund. In all circumstances, once we have been informed of the problem we will take all reasonable measures to ensure you are able to use the goods ordered - by default making the goods available for collection from the Fringe Office, 180 High Street. Tickets ordered CoBO (Care of Box Office) are available for collection from the Festival Fringe Society, 180 High Street, and other Festival Fringe society outlets as we operate from time to time. Unless explicitly agreed CoBO tickets ordered through edfringe.com will not be available for collection at the venue or the venue's box office.

About our liability to you
So far as lawfully possible, we exclude all liability to you in contract or delict (negligence) (other than negligence by us which gives rise to personal injury or death). We also exclude liability for any consequential or indirect loss which may be caused to you by us.

About the law relating to these terms and conditions
We are situated in Scotland and the law of Scotland shall govern any interpretation of these terms and conditions. The Scottish Courts shall have jurisdiction in any disputes between us.
