Updated Terms and Conditions
01. Governing law
These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with their subject matter shall be governed by and construed in accordance with the law of Scotland.
02. Promoter
The Fringe Society Prize Draw is promoted by the Edinburgh Festival Fringe Society, (Registered Charity SC002995), whose registered office is at 180 High Street, Edinburgh EH1 1QS, United Kingdom. Registered as a Small Society Lottery with the City of Edinburgh Council on 18 July 2025 under the Gambling Act 2005.
03. Purpose
This lottery is run to raise funds in support of the charitable work of the Edinburgh Festival Fringe Society. Proceeds will be used to support our charitable aims, including artist development, accessibility and community engagement.
04. Eligibility
- Open to UK residents aged 18 or over only.
- Entrants must not be directly involved in the administration of the draw.
- It is the responsibility of the entrant to ensure they are eligible.
- Entries purchased by or on behalf of ineligible persons will be disqualified.
- The draw is not open to people employed by the Edinburgh Festival Fringe Society during the timeframe of the draw.
05. Tickets and entry
- Each ticket costs £2.
- All tickets must be paid for in full before entry into the draw is permitted.
- Each ticket purchased equals one entry into the draw.
- Multiple entries are permitted, and each will be entered as a separate line.
- Tickets cannot be sold or transferred once purchased.
- No free entry route is offered, in accordance with Small Society Lottery regulations.
- Tickets will be available until the draw deadline or until the maximum number of entries is reached, which is 10,000 entries, whichever comes first.
06. Prize draw and winner selection
- The promoter will run one draw within the timeframe communicated on the draw page and in promotional materials and communications.
- Entries will close no later than 10:00 GMT on the day the draw is scheduled to take place. Any entries received after the advertised closing time will not be included.
- Late entries will be refunded.
- The promoter reserves the right to adjust the draw schedule where necessary, provided any changes are clearly communicated in advance.
- Winners will be selected via a random draw from all eligible, paid entries.
- The draw will be witnessed and recorded, and the results documented.
- The winner drawn first will have first choice of the prizes available. The second winner drawn will have their choice of remaining prizes, and so on. There will be three prize winners in this draw.
- Winners will be contacted using the information provided at the time of entry and notified no later than seven days after the draw.
- If a winner does not respond by 23 January 2026, the Edinburgh Festival Fringe Society reserves the right to re-use the prize in a future draw.
- Entrants’ details will be handled in accordance with data protection laws and our privacy policy.
- The random selection of the winners made by the Edinburgh Festival Fringe Society is final and no correspondence will be entered into over this decision.
07. Prizes
- Prizes will vary for each draw. Full details of the prizes available will be published on the Fringe Society website prize draw page and in promotional materials.
- All prizes are non-exchangeable and non-transferable, and no cash alternative will be offered unless explicitly stated.
- Where a prize includes alcohol, winners must be able to legally collect it in accordance with licensing laws. Proof of ID must be provided on collection.
- Prizes must be collected by the winner from the Fringe Box Office or Shop at 180 High Street, Edinburgh, EH1 1QS unless they can be shared digitally.
- No individual prize will exceed a retail value of £25,000, in accordance with lottery regulations.
- Donated prizes will be valued at fair market value for reporting purposes.
08. Use of funds
- A minimum of 20% of the proceeds from each draw will be applied directly to the charitable purposes of the Fringe Society.
- Up to 80% of proceeds may be used for prizes and the costs of administering the lottery.
- We expect the majority of funds to go towards our charitable work.
09. Data protection
- Entrant data will be collected and processed for the administration of the prize draw.
- Data will be handled securely and in line with the Fringe Society’s Privacy Policy.
10. Complaints and disputes
- Any complaints regarding the lottery should be directed to: [email protected].
- Disputes will be handled in line with our standard complaints policy.
- The Society reserves the right to disqualify any entrant it reasonably believes has breached these terms.
- The draw and these terms and conditions will be governed by Scottish law and any disputes will be subject to the exclusive jurisdiction of the courts of Scotland.
- A failure by us to enforce any one of the terms and conditions in any instance(s) will not give rise to any claim or right of action by any entrant or prize winner, nor shall it be deemed to be a waiver of any of our rights in relation to the same.
- To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any entrant or prize winner in connection with the draw howsoever caused, including for any costs, expenses and other liabilities.
11. Changes and cancellation
- The Fringe Society reserves the right to cancel or amend the draw where it becomes necessary to do so for reasons beyond its control.
- Any significant changes will be communicated via the Fringe Society website and / or ticketing portal.
- We reserve the right to modify, update or amend these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon publication on our website or other communication channels. Continued participation in the prize draw after such changes constitutes acceptance of the revised Terms and Conditions.
12. Reporting
A return will be submitted to City of Edinburgh Council within three months of each draw, in accordance with the conditions of our registration.
